I had an appointment with an advisor at my local Welfare Rights office today. She was really helpful and is happy to represent me at the tribunal(s). I was able to take a letter from my GP, who is very supportive. Also the documentation from my medical retirement from the Police and also the paperwork relating to the adaptations made to my house by the local Occ Health people. She agreed that there is a lot of this going on, that I have a good case and this is all a disgusting way to treat people. I am still awaiting a date for the tribunal and have sent off the appeal for the DLA. This is all exhausting, frustrating and stressful, but I will get there in the end with help. Jan xxx

Dear Jan, I wish you the very best with your appeal for D.L.A. I have only just caught up with your posts about this and feel horrified that your D.L.A was taken away! As if we don't have enough worry in our lives just trying to cope with R.A from day to day! Thinking of you, Fiona

Despite all of the evidence I sent to appeal the DLA withdrawal, THEY still over ride everything by what the original medical says. I now have to have TWO tribunals. I am still awaiting a date for the ESA tribunal. I was sent copies of absolutely everything, including support from the RA consultant, even the memo informing DLA of the ESA medical, some delightful lady (I use the term loosely) just doing her job by informing on me. You can imagine how I feel reading through the 134 photocopied pages. My kind doctor has put me on diazepam (valium) to help control the spasms in my back and jaw. (probably hooked on that as well now). If it's not all sorted in the next 5 months I lose my car and my independence. Ho Hum. Jan (disgusted of Northants.)

Hi Jan So sorry to hear this, what a bloomin' mess! I don't see how they can override the medical evidence both from your doctor and from the police. It really doesn't make any sense. At the end of the day who is most likely to be cognisant of your difficulties? Your doctors of course!! Blithering idiots ... we're surrounded by incompetent fools in an uncivilised, uncaring society I knew I shouldn't have come on this section it really does infuriate me that people are treated in this way. Do hope you get rightful and fair consideration very soon Jan. Lyn x

They completely overrode all the medical evidence in my hubbies application too Jan. It is infuriating and demeaning. Have you contacted your MP at all? YES I'VE CHANGED, PAIN DOES THAT TO PEOPLE.

Oh Jan, I'm so sorry you are being treated in this way, and Alan as well, Julie.
It's just unthinkable that they can do this to you.
Praying hard for you to win your appeal, they should not get away with it.

Thinking of you jan such stressful situation for you,how they can overide medical evidence not right at all, case for legal advice id of thought grr. glad mp knows of this. hugs melly cuddly cats make my world seem so much more fun

Jan, what a disgraceful way to treat anyone!!! These people must be paid to turn applications down. It seems everyone gets a no from them. The more they turn down the better it would appear!! Good luck with the tribunals, with the support from the advisor, hopefully they will be able to handle it for you, especially with the medical evidence to back it all up. Hi Jan, I am going through exactly the same process of having to face two tribunals: one for ESA and the other for DLA, as the ATOS medical report was also used by DLA to inform their decision not to award me DLA. However, I have also appealed as DLA is not about work and relates to a person's care and mobility needs and legally are regarded as separate benefits. What a joke, at the moment I've got carers coming in twice a day as well weekly visits from community occupational and physiotherapists and the DWP still thinks I am fit to work despite after having been in hospital for the majority of this month!

Oh Barbara, not you too. This is absolutely awful and makes me feel so angry that we aren't even treated like respectable human beings anymore. Wishing you both the very best and hope things are sorted out really quickly. It's bad enough having the problems you have without added stress to make matters even worse.
